Wet & Forget Updated Privacy Policy

This Wet & Forget Privacy Policy applies to websites and other interactive features and online services owned or operated by Wet & Forget US, a New Zealand Limited Partnership (NZLP) (collectively, "Wet & Forget") that post a link to or include this Privacy Policy (collectively, the "Site"). This Privacy Policy describes the collection and use of personal information that may be collected by Wet & Forget anytime you interact with us, such as when you visit our web site, when you purchase Wet & Forget products, or when you call our support associates. This Privacy Policy applies to information we collect through the Site and information we collect offline, which we may combine with online data.

Please also review the Terms of Use, which govern your use of the Site. By using the Site, you agree to the collection, disclosure, and use of your information as described in this Privacy Policy. INFORMATION WE MAY COLLECT THROUGH THE SITE

We collect information from you directly, automatically when you visit the Site and sometimes from third parties. Some of this information may be considered "personal information" under various applicable laws. We consider information that identifies you as a specific, identified individual to be personal information (such as your name, phone number, e-mail address), and we treat additional information, including IP addresses and cookie identifiers, as "personal information" where required by applicable law. And, if we combine information we consider to be non-personal with personal information, we will treat that combined information as personal information under this Privacy Policy. Note that we may de-identify personal information so that it is non-personal, such as by aggregating it or converting it to a code, sometimes using function commonly known as a “hash.” We will treat de-identified information as non-personal to the fullest extent allowed by applicable law.

Information You Provide to Us Directly

Wet & Forget may ask you to provide information directly to us, such as contact information including your name, phone number, mailing address, and email address) and other information about you, such as demographic information (ZIP code, gender, and day and month of birth, for example) and information about your interests and preferences. You may provide personal information, demographic data and other information through various forms and features on the Site or when you otherwise interact with us, such as by calling into our call center. We will also collect personal information and payment information when you make a purchase through us.

Our Site is intended for a general audience and not intended for use by or targeted to those younger than the age of 18. We do not knowingly collect personal information from children younger than the age of 18.

Information We Collect Automatically As You Access the Site

In addition to any personal information or other information you choose to submit to the Site, we, and our third-party business partners (including any third-party advertisers and content or analytics providers), may use a variety of technologies that automatically or passively collect certain information whenever you visit or interact with the Site ("Site Usage Information"). This Site Usage Information may include the website browser or operating system you are using, the URL or advertisement that referred you to our Site, the search terms you entered into a search engine that led you to our Site, all of the areas within our Site that you visit, and the time of day, the next website you visit after leaving our Site, among other information. We may use this Site Usage Information for a variety of purposes, including analyzing trends, administering the Site, tracking users' movements around the Site, gathering demographic information about our user base as a whole, and enhancing or otherwise improving the Site. Site Usage Information is generally non-identifying, but if we associate it with you as a specific and identifiable person, we treat it as Personal Information. As you use the Site, we may also track videos you watch and how you interact with the content. In addition we automatically collect your IP address or other unique identifier ("Device Identifier") for your computer, mobile phone, or other device used to access the Site. A Device Identifier is a number that is automatically assigned to your device used to access the Site, and our servers identify your device by its Device Identifier. We may be able to collect or infer your approximate location based on your Device Identifier or similar information we collect. We use the following types of tracking technologies to automatically collect information when you interact with us online:

Cookies and Local Storage. "Cookies" and local storage are pieces of information (data files) transferred to an individual's browser on their device when the device is used to visit a Site. These technologies are able to store a unique identifier for a device to allow a certain Internet site to recognize the device whenever the device is used to visit the Site. These technologies may be used for many purposes by us and our third-party business partners, such as automatically collecting Site Usage Information, enabling features, serving advertisements to you online and remembering your preferences. We may use cookies and other technologies to study traffic patterns on our web site, to make it even more rewarding as well as to study the effectiveness of our customer communications. And we may use cookies to customize your experience and provide greater convenience each time you interact with us. The information we store includes internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. Certain browsers or browser add-ons, such as Adobe Flash, may provide additional local data storage mechanisms that are used in a manner similar to cookies, and some of the content included on our Site may make use of this local storage. For example, a Flash cookie is a data file placed on a device via the Adobe Flash plug-in that may be built into or downloaded by you onto your device. Flash cookies may be used for various purposes, including, without limitation, enabling a Flash feature and remembering your preferences. If you choose to disable cookies, to adjust your Flash privacy settings on your device, or to otherwise restrict local storage, some features of the Site may not function properly.

Pixel tags. Pixel tags are tiny graphic images or other web programming code that tell us what parts of our web site customers have visited or to measure the effectiveness of searches customers perform on our site. Pixel tags and similar technologies may be used for a number of purposes, including, without limitation, to count visitors to a Site, to monitor how users navigate the Site, to count how many emails that were sent were actually opened or to count how many particular links were actually viewed. Pixel tags also enable us to send e-mail messages in a format customers can read.

Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the Site, such as the links you click on. The code is temporarily downloaded onto your device from our server or a third-party service provider or business partner, is active only while you are connected to a Site, and is deactivated or deleted thereafter.

Click Through URLs. In some of our e-mail messages we use a "click-through URL" linked to content on the Wet & Forget Site. When a customer clicks one of these URLs, they pass through our web server before arriving at the destination web page. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. In addition, we may use a variety of other technologies that collect similar information for security and fraud detection purposes.

User Content Submissions

The Site may provide you the opportunity to participate and post content publicly through the Site. You may choose, through such features or otherwise, to submit or post product reviews, photographs, videos, questions, comments, suggestions or other content (collectively, "User Content"). For example, Wet & Forget may provide you the opportunity to submit User Content in connection with a sweepstakes, contest, or promotion.

Note that anything you choose to submit or publicly post to the Site may be public—others will have access to view, collect, and use your User Content and may share it with third parties. If you choose to voluntarily disclose Personal Information, that information may be considered public information and the protections of this Privacy Policy will not apply. Think carefully before you post and use caution before disclosing any Personal Information.

As set forth in our Terms of Use if you submit User Content to us, the User Content may be used by Wet & Forget for its business and marketing purposes and may be published online or offline.

Social Media Interactions

The Site may permit or facilitate interactions with an interactive third-party website or service ("Social Media"), such as enabling you to "like" or "share" content. If you choose to share content or otherwise post information from or via the Site to Social Media, that information may be public and the third party may have access to information about you and your use of our Site. You may also choose to participate on Social Media in a way that connects that third-party service with our Site, such as posting to one of our pages on a Social Media site. Doing so may allow us to collect (or the third party to share) information about you, including Personal Information, and the third party may allow us to re-post content related to us on our own Site. These third party platforms may be able to collect certain information about your visits to the Site regardless of whether or not you affirmatively interact with the feature and whether or not you are logged into (or have) an account with the third party platform.

We may also receive information about you if other users of Social Media give us access to their profiles and you are one of their connections or "friends". The information we collect is subject to this Privacy Policy. The information collected and stored by the third party remains subject to the third party's privacy practices, including whether the third party continues to share information with us, the types of information shared, and your choices with regard to what is visible to others on that third-party website or service. The third party may allow you to remove the application or feature, in which case we will no longer collect information about you through the application or feature, but may retain the information previously collected.

Send to a Friend Features and Information You Provide about Others

If you send a friend a communication from the Site, the information you provide (names, email addresses, etc.) is used on a one-time basis to facilitate the communication and is not used for any other marketing purpose, unless we obtain consent from that person. If you otherwise disclose any personal information relating to other people to us, you represent that you have the authority to do so and permit us to use the information in accordance with this Privacy Policy.

Information Third Parties Provide About You

We may receive information about you from third parties, including business partners and data providers. For example, if you are on another website and agree to receive information from Wet & Forget, that website will forward your information to us so that we may contact you. We may also supplement the information we collect with outside records from third parties, such as public databases, publicly available Social Media pages, joint marketing partners, or third parties who enhance the information we have about you, for various purposes, such as to provide you with information, services or products, to tailor our content and the offers we show you, or to enhance our products and services. We may combine the information we receive from third parties with information we collect through the Site. In those cases, we will apply this Privacy Policy to the combined information.

HOW WE MAY USE THE INFORMATION COLLECTED

Wet & Forget may use information collected through the Site (including your personal information and Site Usage Information) in order to: (1) allow you to participate in the Site and providing you with services, announcements, information, and any features or activities we offer through the Site, including marketing messages and offers; (2) personalize your experience and tailor content we display to you, such as advertising, recommendations, promotions, and offers we display to you, both on the Site and elsewhere online; (3) process information you provide via your account registration with the Site, including, verifying that your email address is active and valid; (4) fulfill transactions and process payments and orders; (5) provide customer service, including in connection with any delivery, billing, or payment processing inquiries; (6) communicate with you regarding your use of the Site (such as about a transaction, to notify you if you have won a contest or promotion, or to respond to you when you contact us) or other administrative communications, including, in our discretion, changes to the Site's Privacy Policy, Terms and Conditions, or any of our other terms or policies; (7) protect our Site and our customers from errors, misuse of the Site, fraud, or any criminal activity and detect and troubleshoot problems, resolve disputes, and enforce applicable agreements and policies for the Site; (8) use for internal business purposes, such as to improve our Site or our products and services, and to comply with regulatory and legal obligations; or (9) for any other purposes consistent with this Privacy Policy, as disclosed at the time you provide your information, or otherwise with your consent.

WHEN WE DISCLOSE YOUR INFORMATION TO THIRD PARTIES

Wet & Forget may share non-personal information, such as Site Usage Information, hashed and other de-identified data, or aggregated user statistics with third parties in our discretion. Wet & Forget does not share your personal information with unaffiliated third parties for those third parties' own direct marketing purposes. Wet & Forget may share information we have collected about you, including, without limitation, personal information and Usage Information, as disclosed at the time you provide your information or otherwise with your consent, as described in this Privacy Policy and in the following circumstances:

Third Parties Providing Services on Our Behalf. We may share information with third parties who perform services on our behalf, such as website hosting, processing information, sending email or other communications, fulfilling customer orders and processing payments, providing marketing assistance and data analysis (including assessing your interest in our products and services or conducting customer research/satisfaction surveys), and performing other services. We may provide access to your personal information to such service providers in order for them to perform these services. Without such information being made available to our service providers, it might be difficult for you to purchase services, receive customer service, provide us feedback to improve our services, or access certain services, offers, and content on the Wet & Forget web site.

Sweepstakes, Contests, Promotions. We may offer sweepstakes, contests, or other promotions (any, a "Promotion"), that may require registration. By participating in a Promotion, you are agreeing to the provisions, conditions, or official rules that govern the Promotion, which may require specific requirements of you (including, without limitation, and except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice, likeness, or other indicia of persona in advertising or marketing materials). If you choose to enter a Promotion, personal information may be disclosed to third parties or the public in connection with the administration of such Promotion, including, without limitation, in connection with winner selection, prize fulfillment, as required by law or permitted by the Promotion's terms or official rules (such as on a winners list).

When You Request That We Share Your Information. We may share information when you direct us to do so. For example, you may be presented with an opportunity to receive marketing offers from a third party or you make engage with a Social Media service or other third party application or feature, through which information about you is shared. Please note that we are not responsible for the privacy practices of third parties. If you later decide that you no longer want to receive communications from a third party, you will need to contact that third party directly.

Business Transfers. In the event Wet & Forget goes through a transition such as being sold, has all or a portion of its assets acquired or transferred, whether voluntary or involuntary (such as through bankruptcy), or merges or becomes affiliated with any other division, individual or entity (including, without limitation, during the course of any due diligence process), any customer information owned or under the control of Wet & Forget (including, without limitation, your Personal Information) will likely be one of the transferred assets. We reserve the right, as part of this type of transaction, to assign or otherwise transfer your information (including, without limitation, your Personal Information) and other information we have collected from users of the Site. By providing your Personal Information, you agree that we may transfer such information to the acquiring entity without your further consent. For example, if part of our business was sold we may give our customer list as part of that transaction.

THIRD PARTY LINKS AND CONTENT

The Site may link to or incorporate websites or content hosted and served by third parties over which we have no control and which are governed by the privacy policies and business practices of those third parties. Wet & Forget is not responsible for the privacy practices or business practices of any third party.

THIRD PARTY ANALYTICS PROVIDERS, AD SERVERS, and SIMILAR THIRD PARTIES

The Site may contain content served by third parties, including videos, and we work with third party business partners to help us understand how people navigate and use of our Site and to serve Wet & Forget advertisements elsewhere online. In connection with serving content and providing analytics and advertising services, third parties may collect certain information about your visits to this or other web sites, and we may receive information regarding the use of the Site and the effectiveness of our advertisements. These third parties may set and access their own tracking technologies on your device (including cookies and web beacons) and may otherwise collect or have access to information about your visits to and activity on the Site as well as other web sites or online services. Some of these parties may collect personal information from you over time when you visit the Site or other websites and services. We may also share non-personal, aggregated or de-identified or hashed information at our discretion, including to serve you with relevant advertising, and to allow others to do so. One analytics provider with whom we may work is Google Analytics. Google Analytics uses cookies and similar technologies to collect and analyze information about use of the Site and report on activities and trends. This service may also collect information regarding the use of other websites, apps, and online resources. We may share Usage Information about visitors with third party advertising companies, analytics providers and other third parties for similar purposes.

While we may use a variety of service providers and third party business partners to perform advertising and analytics services, some of these companies are members of the Network Advertising Initiative ("NAI") or the Digital Advertising Alliance ("DAA") Self-Regulatory Program for Online Behavioral Advertising. HOW WE RESPOND TO "DO NOT TRACK" SIGNALS

We therefore cannot ensure or warrant the security of any information that you transmit to us, or that we transmit to you, or guarantee that it will be free from unauthorized access by third parties. You use the Site and provide us with information at your own initiative and risk.

CONSENT TO TRANSFER AND STORAGE IN THE UNITED STATES

Wet & Forget US is a New Zealand Limited Partnership operating only in the United States and Canada. Please be aware that information we collect will be transferred to and processed in the United States and Canada. By using the Site, or providing us with any information, you fully understand and unambiguously consent to this transfer, processing, and storage of your information in the United States and Canada, the privacy laws of which may not be as comprehensive as those in the country where you reside and/or are a citizen. As a result, this information may be subject to access requests from governments, courts, or law enforcement in the United States and Canada according to laws in those jurisdictions.

ACCESSING AND UPDATING YOUR INFORMATION AND YOUR CHOICES

You can unsubscribe from marketing emails through the opt-out mechanism included in each marketing email we send to you or by contacting us via email at info@WetandForget.com. Naturally, if you notify us that you do not want us to use your information for a particular purpose, we will not do so. Note that we reserve the right to send you certain email or postal communications relating to your use of our Site, service announcements, notices of changes to this Privacy Policy or our other terms, or similar administrative or transactional messages, and these transactional account messages may be unaffected if you choose to opt-out from marketing communications.

You may have the opportunity to utilize features on the Site that permit you to register for a user account. If you have an online account, you are responsible for maintaining and updating, as applicable, your account registration data with current, accurate, and complete information. Any changes will be effective immediately upon the posting of the revised Privacy Policy unless otherwise specified, and your continued use of the Site after the effective date of the revised Privacy Policy (or such other act as specified in the revised Privacy Policy) will constitute your consent to those changes to the fullest extent allowed by applicable law. California Consumers have the right to request: (1) that we disclose to you what Personal Information we collect, use, disclose, and sell, including the right to request that we provide to you the specific pieces of Personal Information we have collected about you in the prior 12 months (“Right to Know”); (2) that we delete the Personal Information we collect about you (“Right to Delete”); (3) to opt-out from the sale of Personal Information, all subject to exceptions set forth in the CCPA. Authorized Agents

If you are an agent submitting a request on a consumer’s behalf, you may do so by following the instructions below for making a request Using This Form We will follow up to request additional information and a declaration signed by the individual who is the subject of the request authorizing you to make the request on their behalf. The written permission must state your full legal name, the full legal name of the individual who is the subject of the request, and needs to be clear about the permission granted. Alternatively, you may submit a copy of a power of attorney under Probate Code sections 4000-4465. In either case, please also indicate in your email the nature of your request. The consumer’s identity, in addition to your own, will need to be independently verified in order for us to be able to fulfill your request. We may also ask the consumer to directly confirm with us that they provided you permission to submit a request. Please keep in mind that if we do not receive adequate proof that you are authorized to act on the consumer’s behalf, we may deny the request.

Verifying Requests

Please note that we will take steps to verify your identity in order to fulfill your request. In order to verify your identity, we will request that you provide the following pieces of information your request: your first and last name and the phone number and email address that you have previously provided to Wet & Forget.

If we are unable to verify that the individual submitting the request is the same individual about whom we have collected information (or someone authorized by that individual to act on their behalf), we will not be able to process the request.

In order to have us provide specific pieces of information, we will require a signed declaration under penalty of perjury that you are the consumer whose Personal Information is the subject of the request.

REQUEST TO DELETE

To ensure that we do not delete your personal information in response to a fraudulent request, once you submit the request, we may follow up to confirm that you want your information to be deleted.

RIGHT TO OPT-OUT OF THE SALE OF PERSONAL INFORMATION

The CCPA provides a right to California Consumers to request to opt-out of the sale of Personal Information. As indicated above, we may allow third-party advertising companies to collect data from visitors to our Site, including to better serve you more relevant advertisements. Wet & Forget does not currently sell your covered information as those terms are defined under applicable Nevada law. However, you may still submit an opt-out request and we will honor that request as required by Nevada law if Wet & Forget were to engage in such a sale in the future. Your request must include your full name, street address, city, state, zip code, and an email address so that we are able to contact you if needed regarding this request.
